1. Agreement to Terms

By accessing or using AISweb's (ACN 630 782 115) web hosting services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

AISweb provides web hosting, domain registration, email hosting, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

3. Account Registration

To use our services, you must:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Promptly update your account information when necessary
• Notify us immediately of any unauthorised access to your account

You are responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Transmit spam, malware, or malicious code
• Host illegal content or engage in fraudulent activities
• Overload or interfere with our servers or networks
• Attempt to gain unauthorised access to other systems
• Host content that is defamatory, obscene, or hateful
• Engage in phishing or other deceptive practices

Violation of this policy may result in immediate suspension or termination of your account.

5. Payment Terms

Billing

• Services are billed in advance on a monthly or annual basis
• All prices are in Australian Dollars (AUD) unless otherwise stated
• Prices are subject to change with 30 days notice
• You authorise us to charge your payment method for all fees due

Refunds

• We offer a 7-day money-back guarantee for new hosting accounts
• Domain registration fees are non-refundable
• Refunds are processed to the original payment method within 7-10 business days

Late Payments

• Accounts with overdue payments may be suspended without notice
• A reconnection fee may apply for reactivation of suspended services
• We reserve the right to delete data from accounts suspended for more than 30 days

6. Service Level Agreement (SLA)

We guarantee 99.99% uptime for our hosting services. If we fail to meet this guarantee, you may be eligible for service credits as outlined in our SLA. The uptime guarantee does not apply to:

• Scheduled maintenance
• Issues caused by your actions or third-party services
• Force majeure events
• Network or hardware issues beyond our control

7. Data Backup and Security

While we perform regular backups of our servers, you are solely responsible for maintaining your own backups of your data. We are not liable for any data loss, regardless of the cause.

8. Resource Limits

Hosting plans are subject to fair use policies and resource limits. Excessive use of CPU, memory, or bandwidth may result in suspension or upgrade requirements. We will notify you before taking action when possible.

9. Domain Names

• You are responsible for ensuring domain names do not infringe on trademarks
• Domain renewals are your responsibility
• We are not liable for loss of domain names due to non-renewal
• Domain transfers are subject to registry policies and may take 5-7 days

10. Intellectual Property

You retain all rights to your content. By using our services, you grant us a limited license to host, store, and display your content as necessary to provide our services. All AISweb branding, logos, and website content are our intellectual property.

11. Termination

By You

You may cancel your services at any time through your client area. Cancellations take effect at the end of your current billing period. No refunds are provided for partial billing periods except as outlined in our refund policy.

By Us

We may suspend or terminate your account immediately if you:

• Breach these Terms of Service
• Fail to pay for services
• Engage in fraudulent or illegal activities
• Use excessive server resources

12. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount you paid for services in the past 12 months
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for loss of profits, data, or business opportunities
• Services are provided "as is" without warranties of any kind

13. Indemnification

You agree to indemnify and hold AISweb harmless from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your infringement of any third party rights.

14. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

15. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through your client area. Continued use of our services after changes constitutes acceptance of the modified terms.

16. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Australia.

17. Governing Law

These Terms of Service are governed by the laws of Australia, without regard to conflict of law principles.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
